The following hearing of the International Court of Appeal took place yesterday in Paris:

Appeal lodged by Prema Powerteam s.r.l. against decision No. CS 2/19 of the Italian National Court of Appeal upholding the Stewards’ decision No. 3 taken within the framework of the Competition held in Le Castellet (FRA) counting towards the international series “Formula Regional European Championship”.

On 13 April 2019, the Stewards decided to disqualify car No. 64 (entered by Competitor Prema Powerteam and driven by Olli Caldwell) from the results of Race 2, on the basis of a technical irregularity reported by the Technical Delegate (front damper mounted on a rear suspension).

On the same day, Prema Powerteam decided to appeal the Stewards’ decision before the Italian National Court of Appeal.     

On 17 May 2019, the Italian National Court of Appeal heard the parties concerned and confirmed the Stewards’ decision. The Competitor was notified of this decision on 13 June 2019.

On 19 June 2019, Prema Powerteam lodged an appeal against the decision of the Italian National Court of Appeal before the International Court of Appeal.

Decision of the International Court of Appeal

The Court, after having heard the parties and examined their submissions, decided:

• To uphold the Decision No. CS 2/29 of the Italian National Court of Appeal rejecting the appeal  against the Decision No. 3, dated 13 April 2019, of the Stewards of the Le Castellet Competition counting towards the 2019 Formula Regional European Championship;
• To confirm the disqualification of Car No. 64 of Prema Powerteam s.r.l.  (driver Ollie Candwell) from the Le Castellet Competition counting towards the 2019 Formula Regional European Championship;
• To order the competent Sporting Authority to draw, as appropriate, the consequences of this ruling.

The International Court of Appeal was presided over by Mr Philippe NARMINO (Monaco), and included Mr Javier BONE MATHEU (Spain), Mr Thierry JULLIARD (Switzerland) and Mr Jean-Christophe LEROY (France).
