International Court of Appeal - Decision - Hearing July 28, 2015

The following hearing of the International Court of Appeal took place in Paris on Tuesday 28 July 2015:

Appeal brought by the Österreichischer Automobil Motorrad und Touring Club-Oberste Nationale Sportkommission für den Kraftfahrsport in Österreich (ÖAMTC-OSK) on behalf of its licence-holder Gottfried Grasser Ges.m.b.H. (Grasser Racing Team) against a decision dated 20th May 2015 of the National Court of Appeal of the Royal Automobile Club of Belgium (RACB), which confirmed the decision No. 49 of the Panel of the Stewards excluding car No. 19 of Grasser Racing Team from the results of the race run in Monza (Italy) on 12th April 2015 counting towards the 2015 Blancpain Endurance Series.

On April 12, 2015, following a report from the Technical Director, the Stewards, by decision No. 49, decided to exclude car No. 19 of Grasser Racing Team from the results of the race run in Monza (Italy) on April 12, 2015 counting towards the 2015 Blancpain Endurance Series for a breach of Article 257 A Appendix J 6.1.4 (non-conformity of a refuelling restrictor).

On April 12, 2015, the competitor decided to lodge an appeal before the Belgian National Court of Appeal.

On May 20, 2015, the Belgian National Court of Appeal decided to confirm decision No. 49 of the Stewards.

On June 10, 2015, the ÖAMTC-OSK, on behalf of its licence-holder, decided to appeal this decision before the FIA International Court of Appeal.

Decision of the International Court of Appeal

The Court, after having heard the parties and examined their submissions,

-        declared the appeal admissible;

-        decided to set aside the decision of the National Court of Appeal of the RACB taken on 20 May 2015 and the decision No. 43 dated 12 April 2015 of the Stewards of the competition of Monza counting towards the international Blancpain GT Series 2015..

The International Court of Appeal was presided over by Mr Thierry JULLIARD (Switzerland), and included Mr Vassilis KOUSSIS (Greece) and Mr Ladislav VOSTAREK (Czech Republic).
