International Court of Appeal - Decision - Hearing 16 September, 2016

The following hearing of the International Court of Appeal took place in Paris on Friday 16 September 2016:

Appeals brought by the Automobile Competition Committee for the United States (ACCUS) on behalf of the competitor Dragon Racing against decisions No. 5 and 10 dated 3 July 2016, taken by the stewards of the London competition counting towards the 2015-2016 FIA Formula E Championship

On 3 July 2016, during the London competition, the Stewards noted that, on the basis of a report submitted by the Technical Delegate, the driver Jean-Eric Vergne, car No. 25 of the competitor DS Virgin Racing Formula E Team, had breached the Sporting and Technical Regulations of the Championship by exceeding the maximum amount of energy that can be delivered to the Motor Generator Unit by the rechargeable energy storage system.

The Stewards decided (Decision No. 5) to impose a drive-through penalty on car No. 25.  The penalty was imposed after the end of the race and therefore converted into a time penalty of 50 seconds.

During this same Competition, the Stewards noted, on the basis of a report of the Race Director, that driver Jean-Eric Vergne had also breached Article 30.12 of the Championship Sporting Regulations when leaving the pit lane.

The Stewards decided (Decision No.10) to impose a one second time penalty on driver Jean-Eric Vergne.

On 6 July 2016, the ACCUS, on behalf of his licence-holder Dragon Racing, decided to appeal the decisions No. 5 and 10 taken by the Stewards of the London competition.

Decision of the International Court of Appeal

The Court, after having heard the parties and examined their submissions, declared the appeals inadmissible.

The International Court of Appeal was presided over by Mr Harry DUIJM (Netherlands), and included Mr Riccardo LA COGNATA (Italy), Mr Patrick RAEDERSDORF (Switzerland) and Ms Waltraud WUENSCH (Germany).
