The FIA General Assembly, held in Paris, France, today, marked the end of the annual meeting week attended by sport and mobility FIA Member Clubs from around the world and which culminates with the FIA Prize Giving Gala this evening. The FIA President, Jean Todt, along with Senate President Nick Craw and Deputy Presidents Brian Gibbons and Graham Stoker, welcomed the delegates to the meeting, thanking them for their active participation in the week’s activities.

Jean Todt also paid tribute to President Nelson Mandela, following the sad news of his passing yesterday. Throughout his life Mandela fought with wisdom, courage and dignity and the Members of the FIA General Assembly joined the President standing for a minute’s silence in his honour.

In his acceptance speech, Jean Todt - on behalf of the Presidential team - thanked the Members for their support and trust, emphasising his determination, with the Membership, to make the FIA a bigger and stronger organisation. The President underlined that as a unique organisation with unique people with values from different origins, the challenges faced by Sport and Mobility were immense, but that by being united and working together, we can make a difference.

President Todt continued by confirming his desire to open a new chapter in the FIA’s history, to create a stronger future for motor sport and to drive the agenda of mobility. Further expanding, he advised the plan was based on the four pillars of his manifesto, with the first pillar aiming to continue to improve the governance and administration of the FIA with the assistance of the Statutes Review Commission and the Resource Allocation Working Group, which will determine how best to use the resources arising from new activities and, in particular, the re-negotiation of the Concorde Agreement. A Liaison Office will also be created, providing a one-stop shop for members seeking advice, and a united Global Training Initiative - today offered by the FIA University and FIA Institute - will strongly enhance training programmes.

The second pillar will focus on the development of motor sport, especially at grassroots level. A dedicated department within FIA Sport will work in harmony with the World Motor Sport Council, implementing its strategic direction in relation to the two existing Development Task Forces. A Motorsport Development Fund will be created to replace the Fund which was formed as a result of the McLaren fine which comes to an end next year. Support for the ASNs will be strengthened and regional co-operation reinforced. As importantly, the working relationship with the Olympic community will be further developed and enhanced.

Pillar three is to place the FIA at the forefront of the automotive agenda. The environment in which Mobility Clubs operate is going through a period of profound change and the World Council for Automobile, Mobility and Tourism will take on an extended role to give it a more strategic position. The FIA will also play a role in influencing the development of the vehicles of tomorrow, particularly at major international forums. The Policy Commission will also be asked to develop a comprehensive Policy Roadmap for Mobility.

The fourth and final pillar will focus on tackling the challenges of road safety and sustainable development. The FIA will strengthen its partnerships with all major international players working on road safety, whether it is the United Nations, the World Health Organisation, the World Bank or regional development banks. The work of the Expert Road Safety Panel will be extended to provide an online platform where clubs can share information and experiences, and the FIA Action for the Environment campaign will focus on developing environmentally-responsible sport.

In closing, Jean Todt thanked the FIA Member Clubs for their support and acknowledged them as global ambassadors, binding the organisation, its goals and ambitions to become even stronger, more united and more respected around the world.

Amendments to the FIA Statutes

Amendments have been made to the FIA Statutes as follows:

• A Closed Road Commission has been created with responsibility for the safety of competitions taking place on roads, as opposed to circuits. In particular, the Commission’s duties regarding safety will include the route and layout of the roads and tracks, the safety measures for the drivers and spectators, and the general safety measures pertaining to the organisation and supervision of these competitions. Ari Vatanen was elected as President of the Commission.

• Following a review by its members, it was agreed to dissolve the FIA Academy and remove it from the FIA Statutes. The review revealed weaknesses in the FIA Academy’s processes, as well as a lack of visibility for the prizes and their recipients. In addition, there was confusion around the use of the name of the FIA Academy in light of other similarly named FIA bodies. In its place, new FIA prizes will be developed as well as a new process for selecting and awarding the prizes, including a jury.

 

Annual report of the Ethics Committee

The Ethics Committee members met for the first time on 30 January 2013 and elected Robert Jones as President for a mandate of two years, in compliance with Article 18.3 of the FIA Statutes.

The Committee has drawn up an "FIA Declaration of Interest Form", to prepare and keep up to date a Register of declared interests and to amend Article 2.4 so that it provides that, in the case of duties being performed for the FIA, it is the responsibility of the FIA Parties concerned to declare their interests using this form, and that they must provide complete and accurate information. The "FIA Declaration of Interest Form and Guidance" were approved by the WCAMT and the WMSC during 2013 and were adopted by the FIA General Assembly today for application from 1 January 2014.

In addition to this declaration procedure, the Ethics Committee proposed that Articles 2.4 and 5.3 of the Code specify that any failure to provide information following a request from the Ethics Committee at any time (whether in the context of an investigation or outside it) shall constitute a breach of the Code. This proposal was adopted by both World Councils earlier this year and was approved by the FIA General Assembly today.

The Ethics Committee has also published internal guidelines to ensure fair processes will be followed by the Ethics Committee. The Guidelines explain how the Ethics Committee applies the Code in practice and were published on the FIA website earlier this year.

 

Judicial and Disciplinary Rules

The amount of the appeal fee before the International Court of Appeal, which will now be known as an appeal deposit, is set at €6000 for all cases.

In order to exercise effective disciplinary competence over all its executive officers, the General Assembly agreed to give the International Tribunal (IT) power to impose sanctions upon any executive officer of the FIA who has contravened its articles, and to give the IT the option of imposing appropriate disciplinary sanctions.

The time limit for notification of an appeal by an ASN, FIA member, or a person appealing against a decision of the Stewards before the International Court of Appeal has been amended to 96 hours.

 

FIA 2012 Financial Accounts

The FIA Membership has unanimously approved the 2012 FIA Financial Accounts and the 2014 FIA Budget.

 

International Historical Commission

The General Assembly approved the proposal by Michel de Thomasson, President of the International Historical Commission, of its 24-strong membership and three co-opted members.

The ‘Turin Charter’, as proposed by the Commission, was also adopted by the General Assembly. This internationally-recognised document sets out to define the requisite criteria and conditions so that historic cars can be protected as cultural property; the goal being to protect the historical value of these cars by limiting their modification and defining recommendations regarding use, preservation and refurbishment.

The General Assembly approved the nomination of four judges to the International Tribunal and eight judges to the International Court of Appeal, each proposed by the Judicial Appointment Committee for a three-year mandate commencing 1 January 2014.

The Congress also wished to honour the memory of Reginald Redmond (IRL), a judge at the ICA since 1998, who passed away on 5 April 2013. His kindness, equalled only by his competence, marked his contribution for the benefit of the FIA.

 

Anti-Doping Disciplinary Committee

The General Assembly approved the nomination and/or re-nomination of four members to the Anti-Doping Disciplinary Committee proposed by the WMSC. The members, who will serve from 2014-2016, are:

Resolution of the General Assembly on access to data and telematics platforms

The General Assembly backed a resolution from the WCAMT underlining the rights of consumers to own and control the data generated from their vehicle and to transfer that information to a service provider of their choice. The resolution was presented to the World Council earlier this week alongside an interim status report on access to data and telematics platforms produced by the FIA’s Policy Commission. The report states that Access to Repair and Maintenance Information (RMI) is essential to enable FIA clubs to provide a quality member service, including roadside assistance. The FIA and its Members resolve to ensure these consumer rights through advocating laws and standards, influencing industry practice and co-ordinated information and awareness campaigns.

The 2014 FIA Annual General Assembly and Prize-Giving Gala will take place on 5 December at a venue to be confirmed.

ASSEMBLEE GENERALE ANNUELLE DE LA FIA

L’Assemblée Générale de la FIA, qui s’est tenue à Paris, ce jour, a marqué la fin de la semaine de réunions annuelle, à laquelle ont participé des Clubs membres Sport et Mobilité du monde entier et dont le point d’orgue est le Gala de Remise des Prix de la FIA organisé ce soir. Le Président de la FIA, Jean Todt, ainsi que le Président du Sénat, Nick Craw, et les Présidents-Délégués Brian Gibbons et Graham Stoker, ont souhaité la bienvenue aux délégués et les ont remerciés pour leur participation active aux travaux de la semaine.

Jean Todt a également rendu hommage au Président Nelson Mandela, suite à la triste nouvelle de son décès survenu la veille. Tout au long de sa vie, Mandela s’est battu avec sagesse, courage et dignité et les Membres de l’Assemblée Générale de la FIA se sont joints au Président pour observer une minute de silence en son honneur.

Dans son discours qui a suivi l’élection, Jean Todt - au nom de l’équipe présidentielle - a remercié les Membres pour leur soutien et leur confiance et s’est dit déterminé à faire de la FIA une organisation plus grande et plus forte. Le Président a souligné que la FIA étant une organisation unique, composée de personnes uniques ayant des valeurs de différentes origines, les défis auxquels doivent faire face le Sport et la Mobilité sont immenses mais qu’en restant unis et en travaillant ensemble, nous pouvons faire la différence.

Le Président Todt a poursuivi en confirmant sa volonté d’ouvrir un nouveau chapitre de l’histoire de la FIA, de créer un avenir plus solide pour le sport automobile et de conduire l’agenda automobile. Il a par la suite indiqué que le plan était fondé sur les quatre piliers de son manifeste, le premier pilier visant à continuer d’améliorer la gouvernance et l’administration de la FIA, avec l’aide de la Commission de Révision des Statuts et du Groupe de Travail sur l’Allocation des Ressources, ce qui permettra de déterminer la meilleure façon d’utiliser les ressources découlant de nouvelles activités et, en particulier, de la renégociation de la Convention de la Concorde. Un Bureau de Liaison sera également créé et constituera un guichet unique pour les membres cherchant un conseil et une Global Training Initiative – aujourd’hui proposée par la FIA University et l’Institut FIA – viendra renforcer les programmes de formation.

Le deuxième pilier sera axé sur la croissance du sport automobile, notamment à sa base. Un département dédié au sein de la FIA Sport travaillera d’entente avec le Conseil Mondial du Sport Automobile, en mettant en œuvre sa stratégie concernant les deux Development Task Forces existantes. Un Motorsport Development Fund sera créé pour remplacer le Fonds institué suite à l’amende McLaren qui touche à sa fin l’année prochaine. Le soutien aux ASN sera renforcé ainsi que la coopération régionale. Tout aussi important, les relations de travail avec la communauté olympique seront développées et améliorées.

Le troisième pilier vise à faire de la FIA le chef de file de l’agenda automobile. Le contexte dans lequel opèrent les Clubs Mobilité est en profonde mutation et le rôle du Conseil Mondial de la Mobilité Automobile et Tourisme sera étendu pour lui donner une dimension plus stratégique. La FIA jouera également un rôle en influençant le développement des véhicules de demain, en particulier dans les grands forums internationaux. La Commission Politique sera également invitée à élaborer une Feuille de Route Politique globale pour la Mobilité.

Le quatrième et dernier pilier se concentrera sur les défis à relever en matière de sécurité routière et de développement durable. La FIA renforcera ses partenariats avec tous les grands acteurs internationaux œuvrant dans le domaine de la sécurité routière, qu’il s’agisse des Nations Unies, de l’Organisation mondiale de la santé, de la Banque mondiale ou des banques de développement régionales. Les travaux du Panel d’experts sur la sécurité routière seront étendus afin d’offrir une plateforme en ligne où les Clubs pourront partager informations et expériences et la campagne de la FIA Action for the Environment mettra l’accent sur le développement d’un sport automobile respectueux de l’environnement.

En conclusion, Jean Todt a remercié les Clubs Membres de la FIA pour leur soutien et a rendu hommage à leur rôle d’ambassadeurs mondiaux, appelant l’organisation avec ses objectifs et ambitions à devenir encore plus forte, plus unie et plus respectée dans le monde entier.

Amendements aux Statuts de la FIA

Des amendements ont été apportés aux Statuts de la FIA comme suit :

 

• Une Commission des Epreuves sur Route a été créée qui aura en charge la sécurité des compétitions se déroulant sur routes a contrario des circuits. Les fonctions de la Commission en matière de sécurité incluront notamment le tracé et l’aménagement des routes et parcours, les mesures de sécurité pour les conducteurs et les spectateurs, les mesures de sécurité générales dans le cadre de l’organisation et de la supervision des compétitions. Ari Vatanen a été élu Président de la Commission.

 

• Suite à un examen réalisé par ses membres, il a été convenu de dissoudre l’Académie de la FIA et de la supprimer des Statuts de la FIA. L’examen a révélé des faiblesses dans le fonctionnement de l’Académie de la FIA, ainsi qu’un manque de visibilité pour les récompenses et leurs bénéficiaires. En outre, la confusion régnait autour de l’utilisation du nom de l’Académie de la FIA du fait que d’autres instances de la FIA portent le même nom. En remplacement, de nouvelles récompenses FIA seront instaurées ainsi qu’un nouveau processus de sélection et d’attribution des récompenses, jury y compris.

 

Rapport annuel du Comité d’Ethique

Les membres du Comité d’Ethique se sont réunis pour la première fois le 30 janvier 2013 et ont élu Robert Jones comme Président pour un mandat de 2 ans, en vertu de l’Article 18.3 des Statuts de la FIA.

 

Le Comité a établi un "Formulaire de Déclaration d’Intérêts de la FIA", en vue de préparer et tenir à jour un Registre des intérêts déclarés et de modifier l’Article 2.4 afin qu’il dispose, dans le cas où la mission est accomplie pour la FIA, qu’il est de la responsabilité des Parties de la FIA concernées de déclarer leurs intérêts au moyen de ce formulaire et de fournir des informations complètes et exactes. Ce "Formulaire de Déclaration d’Intérêts de la FIA" a été approuvé par le CMMAT et le CMSA en 2013 et adopté lors de l’Assemblée Générale de la FIA ce jour pour application au 1^er janvier 2014.

 

Outre cette procédure de déclaration, le Comité d’Ethique a proposé de préciser aux Articles 2.4 et 5.3 que tout défaut de fournir des informations suite à une demande du Comité d’Ethique (intervenant soit dans le cadre d’une enquête soit en dehors) constitue une violation du Code. Cette proposition a été adoptée par les deux Conseils Mondiaux plus tôt cette année et a été approuvée par l’Assemblée Générale de la FIA ce jour.

 

Le Comité d’Ethique a également publié des lignes directrices internes visant à garantir l’application de procédures équitables. Ces lignes directrices décrivent la mise en application du Code par le Comité d’Ethique et ont été publiées sur le site web de la FIA plus tôt cette année.

 

Règlement Disciplinaire et Juridictionnel

Le montant de la caution d’appel devant la Cour d’Appel Internationale est fixé à 6000 € pour l’ensemble des affaires.

 

Afin d’exercer une compétence disciplinaire effective sur l’ensemble de ses dirigeants, l’Assemblée Générale a décidé de donner compétence disciplinaire au Tribunal International (TI) pour sanctionner tout dirigeant de la FIA qui aurait contrevenu à ses articles et de donner la possibilité pour le TI de prononcer des sanctions disciplinaires adaptées.

 

Le délai pour toute notification d’appel par une ASN, un membre de la FIA ou une personne ayant fait appel contre une décision des Commissaires Sportifs devant la Cour d’Appel Internationale a été porté à 96 heures.

 

Comptes FIA 2012

Les Membres de la FIA ont approuvé à l’unanimité les Comptes FIA 2012 ainsi que le Budget FIA 2014.

 

Commission Historique Internationale

L’Assemblée Générale a approuvé la liste de 24 membres et 2 membres cooptés proposée par Michel de Thomasson (FRA), Président de la Commission Historique Internationale.

 

L’Assemblée Générale a également adopté la "Charte de Turin", sur proposition de la Commission. Ce document reconnu internationalement vise à définir les critères et conditions préalables selon lesquels les voitures anciennes peuvent bénéficier d’une protection au titre de biens culturels, l’objectif étant de préserver la substance historique de ces véhicules en les modifiant le moins possible et en formulant des recommandations traitant de leur usage, de leur préservation et de leur remise en état.

Tribunal International et Cour d’Appel Internationale

L’Assemblée Générale a approuvé la désignation de quatre juges pour le Tribunal International et de huit juges pour la Cour d’Appel Internationale, chacun étant proposé par le Comité des Nominations Juridictionnelles pour un mandat de trois ans débutant le 1^er janvier 2014. 

 

Le Congrès a également tenu à honorer la mémoire de Reginald Redmond (IRL), juge de la CAI depuis 1998, décédé le 5 avril 2013. La FIA n’oubliera pas son extrême gentillesse et son grand professionnalisme.

 

Comité Disciplinaire Antidopage

Résolution de l’Assemblée Générale sur l’accès aux données et aux plateformes télématiques

L’Assemblée Générale a soutenu une résolution du CMMAT soulignant le droit des consommateurs de détenir et contrôler les données générées par leur véhicule et de les transférer au prestataire de services de leur choix. La résolution a été présentée au Conseil Mondial plus tôt cette semaine assortie d’un rapport d’étape sur l’accès aux données et aux plateformes télématiques produit par la Commission Politique de la FIA. Le rapport indique que l’accès aux informations de réparation et de maintenance (RMI) est essentiel pour permettre aux Clubs de la FIA de fournir un service aux membres de qualité, y compris l’assistance routière. La FIA et ses Membres décident de garantir ces droits aux consommateurs via du lobbying en faveur de lois et normes appropriées ainsi que de leur application concrète dans l’industrie et via des campagnes coordonnées d’information et de sensibilisation.

En 2014, l’Assemblée Générale Annuelle et le Gala de Remise des Prix de la FIA auront lieu le 5 décembre en un lieu à confirmer.
