The International Court of Appeal met in Paris on Wednesday May 12, 2004, in order to examine the appeal introduced by the Automobile Club d’Italia/Commissione Sportiva Automobilistica Italiana on behalf of licence-holder BMS Scuderia Italia spa, Ferrari car n°1: Gabriele Gardel, against decision n°GT-03 made by the Panel of the Stewards on May 2, 2004, concerning the incident during the event run at Magny-Cours (France) on May 2, 2004, and counting towards the 2004 FIA GT Championship.
Having heard the explanations of both parties and examined the various documents and other evidence, the Court upheld the decision of the Panel of the Stewards who imposed a 50 second time-penalty on BMS Scuderia Italia spa, Ferrari car n°1, Gabriele Gardel.
The International Court of Appeal was presided over by Mr Vassilis Koussis (Greece), and composed of Mr Xavier Conesa (Spain), Mr Graham Stoker (Great Britain), and Mr Jan Stovicek (Czech Republic).
