DECISION OF THE INTERNATIONAL COURT OF APPEAL

| The International Court of Appeal met in Paris on Wednesday, December 3, 2003, at 9.30 a.m. in order to examine the appeal introduced by the Deutscher Motor Sport Bund e.V. on behalf of licence-holder and competitor Aqua Nova Racing Team Kadach, car N° 3: Wolf Henzler against decision made by the Italian National Court of Appeal on October 21, 2003, concerning an infringement to the Technical Regulations of the 2003 Porsche Michelin Supercup Series, during the event run in Monza (Italy) on September 12-14, 2003 and counting towards the 2003 Porsche Michelin Supercup Series.
Having heard the explanations of both parties and examined the various documents and other evidence, the Court upheld the decision of the Italian National Court of Appeal and confirmed the exclusion of car N° 3 from this event.
The International Court of Appeal was presided over by Mr Xavier Conesa (Spain), and composed of Mr Philippe Roberti de Winghe (Belgium), Mr Graham Stoker (Great Britain), and Mr Reginald Redmond (Ireland).
