The FIA International Court of Appeal met in Paris on Thursday, November 8, 2007, to examine an appeal lodged by the Automobile Club d’Italia/Commissione Sportiva Automobilistica Italiana (ACI/CSAI) on behalf of its licence-holder Prema Power Team against a decision of the Belgian National Court of Appeal on 16 May 2007 in relation to an event run on 22 April 2007 in Zolder (Belgium) and counting towards the 2007 World Series by Renault Championship.
On 21 April 2007, the Stewards of the Meeting decided to exclude driver N°25 of the competitor Prema Power Team from the first race, as his car was not in conformity with the Technical Regulations (flat bottom and bodyshell had allegedly been modified).
The competitor Prema Power Team decided to appeal this decision to the Belgian National Court of Appeal.
At its hearing on 16 May 2007, the Belgian National Court of Appeal confirmed the decision of the Stewards.
Prema Power Team decided to appeal the decision of the Belgian National Court of Appeal to the International Court of Appeal.
Having heard the explanations of both parties and having examined the various documents and other evidence, the Court decided that the appeal was inadmissible as the ACI/CSAI did not confirm its intention to appeal within the time limit of 7 days as is specifically required by Article 17 of the ICA Rules.
The International Court of Appeal was presided over by Mr Erich SEDELMAYER (Austria), elected President, and composed of Mr Xavier CONESA (Spainl), Mr Reginald REDMOND (Ireland) and Mr Dieter ROSSKOPF (Germany).
