The FIA International Court of Appeal met in Paris on Thursday, November 9, 2006, to examine an appeal lodged by the FIA against decisions of the French National Court of Appeal respectively of 24 July 2006 and 1 September 2006 regarding an event run at Varennes sur Allier on 25 June 2006 and counting towards the CIK-FIA 2006 Formula A European Championship.
A red flag had been raised during race N°2 but, due to the flag’s irregular positioning, it was not immediately visible to all competitors. The Panel of the Stewards of the Meeting annuled the result. The French Court of Appeal overturned the Steward’s Decision, which led the FIA to lodge this appeal.
Having heard the explanations of the parties and having examined the various documents and other evidence, the Court:
- quashed the decisions of the French National Court of Appeal,
- stated that the Stewards of the Meeting have the power to annul the results of a race when it is impossible to establish a fair classification in order to avoid any unfair treatment with regard to the competitors and drivers,
- confirmed the decision of the Panel of the Stewards of the Meeting annulling the results of race N°2 of the event run at Varennes sur Allier.
The International Court of Appeal was presided over by Mr Xavier CONESA (Spain), elected President, and composed of Mr Edwin GLASGOW (Great Britain), José MACEDO e CUNHA (Portugal) and Mr Philippe ROBERTI de WINGHE (Belgium).
