The International Court of Appeal met in Paris on Wednesday, November 3, 2004, in order to examine the appeal introduced by the Automobile Club du Grand-Duché de Luxembourg on behalf of competitor Jama Investments Luxembourg, car N°18: Michael Herck, against decision of the Spanish National Court of Appeal on July 15, 2004, concerning the exclusion of car N°18 during the event run at Valencia (Spain) on June 20, 2004, and counting towards the Spanish Formula Junior 1600 Championship.
Having heard the explanations of both parties and having examined the various documents and other evidence, the Court quashed the decision of the Spanish National Court of Appeal.
The International Court of Appeal was presided over by Mr Vassilis Koussis (Greece), and composed of Mr José Macedo e Cunha (Portugal), and Mr Pierre Tourigny (Canada).
