The following hearing of the International Court of Appeal took place in Paris on Tuesday 30 November 2010:
Appeal lodged by the Royal Automobile Club de Belgique (RACB) on behalf of its licence-holder Prospeed Competition ASBL against decision N°18 taken by the Panel of Stewards of the Meeting dated 10 October 2010 concerning the event run at Zolder (Belgium) on 10 October 2010 and counting towards the 2010 FIA GT3 European Championship
Reminder of the facts
At the post race scrutineering of the GT3 event held in Zolder (Belgium), the FIA Technical Delegate found that the weight of the rear brake disks of car N°61 (Prospeed Competition ASBL) was not in compliance with the homologation documents of the car. The Stewards of the Meeting decided to exclude car N°61 from the results of race N°2.
On 12 October 2010, the Royal Automobile Club de Belgique appealed this Stewards’ decision on behalf of its licence-holder Prospeed Competition ASBL.
Decision of the International Court of Appeal
The Court, after having heard the parties and examined their submissions, decided to:
- confirm the decision of the Stewards with respect to the finding that car N°61 of Prospeed Competition ASBL did not comply with its homologation form, and
- in light of the mitigating circumstances, annul the sanction of exclusion imposed by the Stewards and substitute it with a fine in the amount of Euros 10,000 upon the Appellant.
The International Court of Appeal was presided over by Mr Edwin GLASGOW (United Kingdom), and included Mr Jean LUISI (France), Mr José MACEDO e CUNHA (Portugal) and Mr Reginald REDMOND (Ireland).

L’audience suivante de la Cour d’Appel Internationale a eu lieu à Paris le mardi 30 novembre 2010 :
Appel interjeté par le Royal Automobile Club de Belgique (RACB), pour le compte de son licencié Prospeed Competition ASBL à l’encontre de la décision N°18 prise par le Collège des Commissaires Sportifs le 10 octobre 2010 concernant l'épreuve disputée à Zolder (Belgique) le 10 octobre 2010 et comptant pour le Championnat d’Europe GT3 de la FIA 2010.
Rappel des faits
Lors du contrôle technique réalisé à l’issue de l’épreuve de GT3 disputée à Zolder (Belgique), le Délégué Technique de la FIA a constaté que le poids des disques de freins arrière de la voiture N°61 (Prospeed Competition ASBL) n’était pas conforme aux documents d’homologation de la voiture. Les Commissaires Sportifs ont décidé d’exclure la voiture N°61 des résultats de la course N°2.
Le 12 octobre 2010, le Royal Automobile Club de Belgique a fait appel de cette décision des Commissaires Sportifs pour le compte de son licencié Prospeed Competition ASBL.
Décision de la Cour d’Appel Internationale
La Cour, après avoir entendu les parties et examiné leurs mémoires, a décidé :
- de confirmer la décision des Commissaires Sportifs eu égard aux conclusions selon lesquelles la voiture N°61 de Prospeed Competition ASBL n’était pas conforme à sa fiche d’homologation ; et
- au vu des circonstances atténuantes, d’annuler la sanction d’exclusion imposée par les Commissaires Sportifs et de lui substituer une amende d’un montant de 10 000 euros à infliger à l’Appelant.
La Cour d’Appel Internationale était présidée par M. Edwin Glasgow (Royaume-Uni) et était composée de M. Jean Luisi (France), de M. José Macedo e Cunha (Portugal) et de M. Reginald Redmond (Irlande).
