 International Court of Appeal

The following hearing of the International Court of Appeal took place in Paris on Tuesday 18 May 2010:

 

Appeal lodged by the Deutscher Motor Sport Bund e.V. (DMSB) on behalf of its competitor Young Driver AMR against decision N°24 taken by the Stewards of the Meeting dated 2 May 2010 concerning the event run at Silvertone (Great Britain) on 2 May 2010 and counting towards the 2010 FIA GT1 World Championship

 

Reminder of the facts

 

On the basis of a report from the FIA Technical Delegates, finding that the friction block of the flat bottom of car N°7 of Young Driver AMR did not comply with the minimum thickness, the Stewards decided to exclude car N°7 from the race results for breach of Article 257.3.3.2.d.3. of Appendix J of the International Sporting Code and Article 5 of the FIA GT1 World Championship Sporting Regulations.

 

The DMSB appealed the Stewards’ decision on behalf of Young Driver AMR.

 

Decision of the International Court of Appeal

 

The Court, after having heard the parties and examined their submissions, declared the appeal admissible and confirmed the Stewards’ decision, on the ground that the friction block of car N°7 was not in conformity with Article 257.3.3.2.d.3 of Appendix J of the 2010 International Sporting Code, as the 5 mm tolerance does not apply to the minimum thickness of the friction block, but only to the flat bottom of the car.

 

The International Court of Appeal was presided over by Mr Erich SEDELMAYER (Austria), and composed of Mr Xavier BONE (Spain) and Mr Michael GRECH (Malta).
