The following hearing of the International Court of Appeal took place in Paris on Friday 12 November 2010:
Appeals lodged by the Royal Automobile Club Motor Sports Association (MSA) on behalf of its licence-holder Chevrolet World Touring Car Team against decisions N°1 and 2 taken by the Stewards of the Meeting on 30 October 2010 concerning the event run at Okayama (Japan) and counting towards the 2010 FIA World Touring Car Championship
Reminder of the facts
At the WTCC event held in Okayama, the Technical Delegate found that cars N°10 (BMW Team RBM – Augusto Farfus) and N°11 (BMW Team RBM – Andy Priaulx) were equipped with non-homologated gearboxes. The Stewards of the Meeting nonetheless found that the cars were eligible and confirmed their entitlement to participate.
On 2 November 2010, the Royal Automobile Club Motor Sports Association appealed these Stewards’ decisions on behalf of its licence-holder Chevrolet.
Decision of the International Court of Appeal
The Court, after having heard the parties and examined their submissions, declared the appeals admissible and decided to:
- annul decisions N°1 and 2 taken by the Panel of Stewards on 30 October 2010 at the Event run at Okayama;
- exclude cars N°10 and 11 from the results of that Event and
- order that, with regard to the event to be held in Macau (China) on 21 November 2010, any compensation weight to be attributed to cars N°10 and 11 in accordance with Article 79 of the WTCC Sporting Regulations, be calculated on the basis of their results during the three events preceding the event run at Okayama;
