On 25 July 2010, on the occasion of the Grand Prix of Germany counting towards the 2010 Formula One World Championship, the Stewards of the meeting, after hearing the persons concerned, noted an infringement by the Scuderia Ferrari of:
- Article 39.1 of the 2010 Sporting Regulations ("Team orders which interfere with a race result are prohibited")
- and Article 151 c) of the International Sporting Code ("Any of the following offences (…) shall be deemed to be a breach of these rules (...) any fraudulent conduct or any act prejudicial to the interests of any competition or to the interests of motor sport generally").
In the light of the information in their possession, the Stewards decided to impose a fine of $100,000 on the Scuderia Ferrari and to forward the dossier to the FIA World Motor Sport Council.
On the basis of that decision and of the inquiry report, and following the receipt of a report sent by the Stewards to the FIA, the FIA President has decided, in conformity with the new rules of disciplinary procedure adopted at his initiative on 11 March 2010, to submit the case to the judging body of the World Motor Sport Council.
The disciplinary hearing of the World Council will be chaired by the FIA Deputy President for Sport and will take place in Paris on 8 September 2010.

Lors du Grand Prix d'Allemagne du 25 juillet 2010 comptant pour le Championnat du Monde de Formule Un de la FIA 2010, les Commissaires Sportifs, après avoir entendu les personnes intéressées, ont constaté une infraction de la Scuderia Ferrari :
- à l'article 39.1 des Règles Sportives 2010 ("Les directives d'équipe qui interfèrent avec les résultats d'une course sont interdites")
- et à l'article 151 c) du Code Sportif International ("Seront considérés comme infractions (...) tout procédé ou manœuvre déloyale de nature à nuire à la sincérité des compétitions ou aux intérêts du sport automobile").
Au regard des éléments en leur possession, les Commissaires Sportifs ont décidé d'infliger une amende de 100.000 $ à la Scuderia Ferrari et de soumettre le dossier au Conseil Mondial du Sport Automobile de la FIA.
Sur la base de cette décision et du rapport d'enquête, et suite à la réception du rapport transmis par les Commissaires Sportifs à la FIA, le Président de la FIA a décidé, conformément aux nouvelles règles de procédure disciplinaire adoptées à son initiative le 11 mars 2010, de saisir la formation de jugement du Conseil Mondial du Sport Automobile.
L’audience disciplinaire du Conseil Mondial sera présidée par le Président Délégué pour le Sport de la FIA et aura lieu le 8 septembre 2010 à Paris. |
