Tribunal De Grande Instance
The decision handed down by the Tribunal de Grande Instance of Paris on 5 January 2010 at the request of Mr Flavio Briatore and Mr Pat Symonds, which the FIA has appealed, revealed a poor understanding of how the disciplinary procedure before the World Motor Sport Council (WMSC) works. In accordance with the undertakings made by the FIA President during his campaign, it will be proposed at the next General Assembly, at the end of 2010, that a structural reform, on which the FIA Statutes Review Commission is currently working, be adopted to prevent other misunderstandings.
In the meantime, at its meeting in Bahrain on 11 March 2010, the WMSC decided on the one hand to adopt a Code of Practice to clarify the working of its disciplinary procedure, and on the other hand to give the FIA President full authority to seek a definitive outcome, whether judicial or extrajudicial, to the disputes with Mr Flavio Briatore and Mr Pat Symonds, best preserving the interests of the FIA.
After discussions between their lawyers and those of the FIA, Mr Flavio Briatore and Mr Pat Symonds have each made a settlement offer to the FIA President with a view to putting an immediate end to the legal proceedings.
Each of them recognising his share of responsibility for the deliberate crash involving the driver Nelson Piquet Junior at the 2008 Grand Prix of Singapore, as "Team Principal" of Renault F1 where Mr Flavio Briatore is concerned, they have expressed their regrets and presented their apologies to the FIA.
They have undertaken to abstain from having any operational role in Formula One until 31 December 2012, as well as in all the other competitions registered on the FIA calendars until the end of the 2011 sporting season.
They have also abandoned all publicity and financial measures resulting from the judgment of 5 January 2010, as well as any further action against the FIA on the subject of this affair.
In return, they have asked the FIA to abandon the ongoing appeal procedure, but without the FIA recognising the validity of the criticisms levelled against the WMSC’s decision of 21 September 2009, as well as to waive the right to bring any new proceedings against them on the subject of this affair.
Considering that the judgment of 5 January 2010 concerned only the form and not the substance of the WMSC’s decision of 21 September 2009, and that the undertakings and renunciation of all claims expressed by Mr Flavio Briatore and Mr Pat Symonds are in line with what the WMSC is seeking, the FIA President has considered that it is in the best interests of the FIA not to allow the perpetuation of these legal disputes, which have received a great deal of media coverage and which, regardless of the outcome, are very prejudicial to the image of the FIA and of motor sport, and thus to accept this settlement solution, thereby putting an end to this affair.

La décision du Tribunal de Grande Instance de Paris intervenue le 5 janvier 2010 à la requête de Messieurs Flavio Briatore et Pat Symonds, et dont la FIA a fait appel, avait révélé une mauvaise compréhension du fonctionnement de la procédure disciplinaire devant le Conseil Mondial du Sport Automobile (CMSA). Conformément aux engagements du Président de la FIA au cours de sa campagne, il sera proposé à la prochaine Assemblée Générale de la FIA fin 2010 d'adopter une réforme des structures sur laquelle le Comité de Réforme des Statuts de la FIA travaille actuellement, afin de prévenir tout nouveau malentendu.
Réuni à Bahreïn le 11 mars 2010, le CMSA a décidé entretemps, d'une part d'adopter un vade mecum ayant pour objet de clarifier le fonctionnement de sa procédure disciplinaire, et d'autre part de donner tous pouvoirs au Président de la FIA pour rechercher une issue judiciaire ou extrajudiciaire définitive aux contentieux avec Messieurs Flavio Briatore et Pat Symonds préservant au mieux les intérêts de la FIA.
Après discussions entre leurs avocats et ceux de la FIA, Messieurs Flavio Briatore et Pat Symonds ont chacun fait une offre transactionnelle au Président de la FIA en vue de mettre un terme immédiat aux procédures judiciaires.
Reconnaissant chacun sa part de responsabilité dans l'accident provoqué du pilote Nelson Piquet Junior au Grand Prix de Singapour 2008, en tant que "team principal" de Renault F1 en ce qui concerne Monsieur Flavio Briatore, ils ont exprimé leurs regrets et présenté leurs excuses à la FIA.
Ils se sont engagés à s'abstenir de toute fonction opérationnelle en Formule 1 jusqu'au 31 décembre 2012, ainsi que dans toutes les autres compétitions inscrites aux calendriers de la FIA jusqu'à la fin de la saison sportive 2011.
Ils ont aussi renoncé à toutes les mesures de publicité et dispositions financières du jugement du 5 janvier 2010, ainsi qu'à toute autre action contre la FIA au sujet de cette affaire.
En retour, ils ont demandé à la FIA de renoncer à la procédure d'appel en cours, sans pour autant reconnaître le bien-fondé des critiques formulées contre la décision du CMSA du 21 septembre 2009, ainsi qu'à toute nouvelle action contre eux au sujet de cette affaire.
Considérant que le jugement du 5 janvier 2010 n'avait porté que sur la forme et non sur le fond de la décision du CMSA du 21 septembre 2009 et que les engagements et renonciations de Messieurs Flavio Briatore et Pat Symonds vont dans le sens de la volonté du CMSA, le Président de la FIA a estimé qu'il est dans le meilleur intérêt de la FIA de ne pas laisser perdurer des contentieux judiciaires fortement médiatisés qui, qu'elle qu'en soit l'issue, sont très préjudiciables pour l'image de la FIA et du sport automobile, et donc d'accepter cette solution transactionnelle, qui met ainsi un point final à cette affaire.
