The FIA General Assembly held in Paris today marked the end of the annual meetings week, attended by sport and mobility members from around the world. The FIA President, Jean Todt, opened the formal business of the session which commenced at 2pm and ended at 5pm. The following decisions were taken:
Statutes Review Commission
Created one year ago, the Statutes Review Commission ensures that the FIA is best adapted to reality and best equipped to deal with future challenges. Within the context of its work, the Statutes Review Commission asked a working group to draw up proposals on the organisation and operation of the judicial role of the FIA. Upon the completion of the working group’s task, the Statutes Review Commission validated a draft amendment of the Statutes and a draft of Disciplinary and Judicial Rules of the FIA.
The General Assembly unanimously adopted the amendments of the Statutes and the new Judicial and Disciplinary Rules of the FIA.
The following judicial organisation will come into effect as of 1 January 2011: independent judges elected by the General Assembly on proposal of a Judicial Appointment Committee and an International Tribunal in addition to the existing International Court of Appeal.
The Judicial Appointment Committee (JAC) is tasked with examining applications to become a judge in the International Tribunal or the International Court of Appeal, and to propose candidates to the General Assembly for election. The JAC comprises one representative of each World Council, two representatives appointed by the Sporting Commissions in charge of the FIA World Championships, and the current President of the Congress of the International Court of Appeal.
The International Tribunal (IT) will exercise disciplinary authority in the first instance for example in the FIA Formula One World Championship and will judge all infringements of the Statutes, the International Sporting Code and the regulations of the FIA, without prejudice to the powers of the stewards of the meeting at the events. It will comprise 12 judges who will act totally independent of the World Councils and of other FIA bodies. The decisions of the IT can be appealed before the ICA.
The International Court of Appeal (ICA) will keep its present powers and will essentially continue to operate in the same manner. It will comprise 24 judges who will act totally independent of the World Councils and of other FIA bodies.
The IT and the ICA will include judges nominated by competitors of the five FIA World Championships.
The General Assembly approved the nominations of the judges of the International Tribunal and the International Court of Appeal who were proposed by the JAC.
Amendments to the International Sporting Code
The General Assembly approved the World Motor Sport Council proposed modifications to the International Sporting Code in relation to:
-Competitor’s Staff Licence: All those involved in the FIA World Championships are directly subject to the FIA’s jurisdiction. Those who are guilty of conduct contrary to the FIA regulations will be denied access to the areas under the control of the FIA in the events counting towards these championships. The procedure for implementing this system will be examined within the framework of working groups specific to each of the FIA World Championships.
-Road Traffic Offences: The FIA is allowed to impose sanctions on Super Licence holders who commit road traffic offences.
-Fines that can be imposed by the Stewards of the meeting in case of infringement: “…the maximum fine that shall be inflicted is 250,000 euros.”
-Sports betting: the FIA adopted regulations aiming to preserve and maintain the integrity of motor sport when it is endangered by improper betting.
Decade of Action for Road Safety 2011-2020: FIA Action Plan
The Decade of Action for Road Safety calls on the international community to take urgent action to stop the daily tragedy of thousands of preventable deaths and injuries on the world’s roads. The World Motor Sport Council and the World Council for Automobile Mobility and Tourism have jointly agreed to be part of the official launch of the Decade of Action for Road Safety in 2011. FIA will work through its Clubs and its partners: FIA Foundation, FIA Institute, iRAP, and eSafetyAware to achieve the Decade’s goal of saving 5 million lives and preventing 50 million injuries by 2020.
Motor Sport Commissions
The General Assembly approved the first review of Motor Sport Commissions for two decades which now include a new Officials and Volunteers Commission and a Single Seater Commission.

L’Assemblée Générale de la FIA qui a eu lieu ce jour à Paris marque la fin de la semaine de réunions annuelles auxquelles participent des membres sport et mobilité du monde entier. Le Président de la FIA, Jean Todt, a passé en revue l’ordre du jour de la réunion qui a débuté à 14h et s’est terminée à 17h. Les décisions suivantes ont été prises.
Commission de Révision des Statuts
Créée il y a un an, la Commission de Révision des Statuts veille à ce que la FIA soit adaptée au mieux à la réalité et à ce qu’elle soit dotée d’outils pour traiter au mieux tout problème se présentant à l’avenir. Dans le cadre de ses travaux, la Commission de Révision des Statuts a demandé à un groupe de travail de formuler des propositions sur l’organisation et le fonctionnement de la fonction juridictionnelle de la FIA. A l’issue des travaux de ce groupe de travail, la Commission de Révision des Statuts a validé un projet de modification des Statuts et un projet de Règlement Disciplinaire et Juridictionnel de la FIA.
L’Assemblée Générale a adopté à l’unanimité les amendements aux Statuts et le nouveau Règlement Disciplinaire et Juridictionnel de la FIA.
L’organisation suivante pour la fonction juridictionnelle entrera en vigueur à compter du 1er janvier 2011 : des juges indépendants élus par l’Assemblée Générale sur proposition d’un Comité des Nominations Juridictionnelles et un Tribunal International en plus de la Cour d’Appel Internationale existante.
Le Comité des Nominations Juridictionnelles (CNJ) a pour mission d’examiner les candidatures pour devenir juge au Tribunal International ou à la Cour d’Appel Internationale et de proposer des candidats à l’Assemblée Générale pour élection. Le CNJ est composé d’un représentant de chaque Conseil Mondial, de deux représentants désignés par les Commissions Sportives chargées des Championnats du Monde de la FIA ainsi que du Président en exercice du Congrès du Tribunal International et de la Cour d’Appel Internationale.
Le Tribunal International (TI) exercera le pouvoir disciplinaire de première instance par exemple dans le Championnat du Monde de Formule Un de la FIA et connaîtra toutes les infractions aux Statuts, au Code Sportif International et aux règlements de la FIA, sans préjudice des pouvoirs des Commissaires Sportifs sur les épreuves. Il sera composé de 12 juges totalement indépendants des Conseils Mondiaux ainsi que des autres instances de la FIA. Les décisions du TI pourront faire l’objet d’appels devant la CAI.
La Cour d’Appel Internationale conservera ses pouvoirs actuels et continuera pour l’essentiel de fonctionner de la même manière. Elle sera composée de 24 juges totalement indépendants des Conseils Mondiaux ainsi que des autres instances de la FIA.
Le TI et la CAI seront composés pour partie de juges proposés par les concurrents des cinq Championnats du Monde de la FIA.
L’Assemblée Générale a également approuvé les nominations des juges du Tribunal International et de la Cour d’Appel Internationale qui ont été proposées par le CNJ.
Amendements au Code Sportif International
L’Assemblée Générale a approuvé les amendements au Code Sportif International proposés par le Conseil Mondial du Sport Automobile eu égard aux points suivants :
- Licence "Personnel Concurrent" : l’ensemble des acteurs des Championnats du Monde de la FIA sont soumis directement à la juridiction de la FIA et sont privées d’accès aux zones contrôlées par la FIA, lors des épreuves comptant pour ces championnats, les personnes qui se sont rendues coupables de comportements contraires aux règlements de la FIA. La procédure de mise en place de système sera étudiée dans le cadre des groupes de travail spécifiques à chaque Championnat du Monde de la FIA.
- Infractions de la route : la FIA est autorisée à sanctionner les titulaires de Super licence qui commettraient des infractions au code de la route.
- Amendes pouvant être prononcées par les Commissaires Sportifs en cas d’infraction : "… le montant maximal de cette amende est fixé à 250 000 euros."
- Paris sportifs : la FIA a adopté la réglementation visant à préserver et maintenir l’intégrité du sport automobile lorsque celle-ci est mise en danger par des paris irréguliers.
Décennie d’action pour la sécurité routière 2011-2020 : Plan d’action FIA
La Décennie d’action pour la sécurité routière appelle la communauté internationale à prendre des mesures urgentes pour faire cesser cette tragédie quotidienne faisant des milliers de victimes qui pourraient être évitées. Le Conseil Mondial du Sport Automobile et le Conseil Mondial de la Mobilité Automobile et Tourisme ont décidé conjointement de participer au lancement officiel de la Décennie d’action pour la sécurité routière en 2011. La FIA œuvrera au travers de ses Clubs et de ses partenaires : la Fondation FIA, l’Institut FIA, l’iRAP et eSafetyAware pour atteindre l’objectif de la Décennie qui est de sauver 5 millions de vies et d’éviter 50 millions de blessés d’ici à 2020.
Commissions du Sport Automobile
L’Assemblée Générale a approuvé la première révision des Commissions du Sport Automobile depuis deux décennies, qui comptent à présent une Commission des Volontaires et des Officiels et une Commission Monoplace.
